Terms of Use

The Site describes our shop, our flavors and our menu. Everything on it — flavors, menu items, prices, promotions, gear and hours — is provided for general information only and may change at any time without notice. The flavor case rotates daily, so a flavor listed on the Site may not be in the shop on the day you visit. The shop is seasonal and our hours move with the season and the weather; we post the day’s hours on Facebook, and that page — not this Site — is the place to check before you make the trip.

Photographs on the Site are illustrative: actual portions, colors and presentation vary. Nothing on the Site is a binding offer of any product, price or promotion.

Our ice cream and other menu items are made and served in a shop that handles milk, eggs, peanuts, tree nuts, wheat and soy, among other allergens. Flavors are produced on shared equipment and served from shared cases, scoops and prep areas, so cross-contact between flavors and allergens can occur. For that reason we cannot guarantee that any item is free of any allergen — including items described as dairy-free or lactose-free.

Ingredient, nutrition and dietary information on the Site is approximate, based on standard recipes, and provided for general guidance only. It is not medical advice and is not a substitute for speaking with our staff. If you or anyone in your party has a food allergy or intolerance, please tell the staff before you order — they will help you choose.

The Site and everything on it — text, photographs, illustrations, logos, page designs and code — belong to Big Licks or its licensors and are protected by copyright, trademark and other laws. The Big Licks name, the Big Licks logo and the slogan “Have You Had A Big Lick Today?” are trademarks of Big Licks.

You may view the Site and print or save pages for your own personal, non-commercial use. Any other use — including commercial use, republication, or use of our name, logo or photographs — requires our prior written permission.

You agree not to: use the Site for any unlawful purpose; submit a form with false, misleading, infringing or harassing content, or while impersonating another person; interfere with the operation or security of the Site, including its bot protection and rate limits; access the Site or collect content or data from it by automated means, including scraping; or introduce viruses or other malicious code.

The Site hosts two forms: a contact form and an employment application. Submissions reach us by email and are handled as described in our Privacy Policy. Sending us a message does not create any business, professional or confidential relationship, and while we read what you send, we cannot promise to respond to every message.

If you send us ideas or suggestions — a flavor we should make, a shirt we should print — they are voluntary, and we may use them (or not) without restriction, compensation or credit.

You must be at least 15 years old to apply for hourly work. Submitting an application does not create an employment relationship, an offer of employment or a promise of an interview, and does not mean a position is open. Any employment at Big Licks is at-will. The application itself contains the certifications that govern it — including your certification that the information you provide is complete and accurate. Nothing on the Site is an offer to sell a franchise. Franchise offers are made only through the delivery and receipt of our Franchise Disclosure Document, as the disclaimer on our franchise page explains in full.

The Site links to and embeds services we do not control — Facebook, TripAdvisor, GoFundMe, Google Maps and YouTube among them. Those sites have their own terms and privacy policies, a link from us is not an endorsement, and we are not responsible for their content, availability or practices.

THE SITE AND EVERYTHING ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free or secure, or that information on it (including flavor, menu, hours, nutrition and allergen information) is complete, current or accurate.

TO THE FULLEST EXTENT PERMITTED BY LAW, BIG LICKS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, AND OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain warranty disclaimers or damage exclusions, so parts of sections 10 and 11 may not apply to you.

Our Privacy Policy explains what information the Site collects, how we use it and the choices you have, including how cookies and analytics work on the Site. It is part of these Terms.

These Terms, and any dispute arising out of or relating to the Site, are governed by the laws of the State of Maine, without regard to its conflict-of-laws rules. Any such dispute will be brought exclusively in the state courts of Maine sitting in York County or in the United States District Court for the District of Maine, and both you and Big Licks consent to the jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Your use of the Site after a change takes effect means you accept the updated Terms.

If any provision of these Terms is held unenforceable, the rest remain in effect. Our not enforcing a provision is not a waiver of it. These Terms and the Privacy Policy are the entire agreement between you and Big Licks about the Site. This page is written and maintained in English; if it ever appears in another language, the English version controls.
